* Attempt to reverse-engineer, copy, resell, or create derivative works based on the Site’s underlying systems or models;
* Upload or transmit any material that infringes on intellectual property rights or contains viruses or other harmful components;

4. Intellectual Property and Ownership
All content, designs, software, systems, and underlying technology used or provided by the Site, excluding user-generated data, are the exclusive property of ProPlaintiff.ai and its licensors. This includes, without limitation, the website design, AI models, branding, and all associated intellectual property rights.
You are granted a perpetual, royalty-free license to use any work product generated by the Site on your behalf. However:

5. Confidentiality and HIPAA Compliance
All confidential documents and data uploaded to the Site are stored on HIPAA-compliant servers using industry-standard encryption and access controls. We do not access, view, transmit, or use your client or case data for any purpose other than system maintenance, legal compliance, or as directed by you.
You acknowledge and agree that:
* You are solely responsible for obtaining appropriate authorizations or written consents from clients or patients before uploading any protected health information (PHI);
* You are responsible for ensuring that your use of the Site complies with applicable state bar rules, court rules, and professional standards of conduct.
6. Disclaimer of Warranties
The Site and its services are provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness of results.
We do not guarantee that the Site will be error-free, uninterrupted, secure, or that its content will be free of inaccuracies.
7. Limitations of AI Technology
You acknowledge and accept the following limitations of the services:
* AI-generated work product may include errors, omissions, or inaccurate statements;
* The Site is a tool to assist, not replace, legal expertise or professional judgment;
* You are solely responsible for reviewing, verifying, and approving any content before relying on or submitting it in any legal capacity.
ProPlaintiff is not liable for any consequences resulting from the use or misuse of AI-generated outputs.
8. Limitation of Liability
To the maximum extent permitted by law, ProPlaintiff shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or legal standing, arising out of or in connection with your use of the Site.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Site is strictly limited to the amount paid, if any, by you to ProPlaintiff in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless ProPlaintiff, its officers, directors, employees, contractors, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
